This not a case of negligent driving but a case where the driver is allegedly swerving from lane to being wilfully /aware and then hitting the bike at a high speed which could be fatal or will result serious and grievous injuries to the rider and prima facie looks like a case of alleged attempted murder with video evidence recorded should be admitted under the BNS evidence act .
As regards the other sections which one says wont stick first is as alleged is that driver of the car abused and made obscene gestures some are visible in the video footage but hard to prove as the driver will say he was not aware that the bike rider was female and this comes under Outraging a Modesty of Woman the other section is of alleged Stalking following her and then try to allegedly try to hit and run , though video evidence is there but still will be struggle to prove and question will the police add these sections .
The section of alleged Dangerous driving is very much applicable and to simply let it off as Rash and Negligent driving does not fit the pattern where there is alleged wilful action to hit the biker and a attempt to murder causing serious and grievous injuries luckily bike rider survived which the good news.
The alleged audacity to attempt such action comes from some connections and ignorance that nothing will happen and one can behave like psycho and the woman biker if she files a complaint and FIR is registered will have to go through the grind of justice system which in itself is a learning experience for the victim and then the driver alleging that biker were not riding properly and CCTV footage should be taken to examine his version of events and there in lies the whole matter getting footage and then reaching that stage where the evidence is admitted and then reaching the stage where it is examined is a long journey .
It will be interesting to know under what sections the drivers has been booked on the basis of video footage and there is always twist and the other side and here in lies the punishment and learning .
